The Municipal Waste Planning, Recycling and Waste Reduction Act (
Act 101) of 1988, among other things, established requirements for municipalities, such as Loyalsock Township, to implement recycling programs.
Recycling Ordinance
Act 101, Chapter 15 requirements which impact Loyalsock Township:
- Each municipality with a population of more than 10,000 people is required to implement a source-separation and collection program for recyclable materials.
- The municipality must adopt an ordinance or regulation requiring all of the following:
- Residents must separate at least three materials deemed appropriate by the municipality from other municipal waste. The three materials shall be chosen from the following: clear glass, colored glass, aluminum, steel and bimetallic cans, high-grade office paper, newsprint, corrugated paper and plastics.
- Residents must separate leaf waste from other municipal waste, unless those residents have otherwise provided for the composting of leaf waste.
- Commercial, municipal and/or institutional establishments must separate high grade office paper, aluminum, corrugated paper and leaf waste and other materials deemed appropriate by the municipality generated at commercial, municipal or institutional establishments and from community activities.
- The municipality must provide a scheduled day, at least once per month, during which separated materials are collected curbside. The municipality shall explain how the system will operate, dates of collection, responsibilities of persons within the municipality, incentives and penalties.
